Torvela respects the intellectual property rights of others and expects users of its platform to do the same.   3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with information reasonably sufficient to permit Torvela to locate the material. Where possible, please include the specific URL or URL(s) where the allegedly infringing content is located.
  4. Your contact information, including your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorised to act on behalf of the owner of the copyright interest that is allegedly infringed.

3. Our Response to a Valid Notice

Upon receipt of a properly submitted and complete notice of claimed copyright infringement, Torvela will take the following steps:

  • Review the notice to verify that it meets all applicable requirements.
  • Promptly remove or disable access to the material that is claimed to be infringing.
  • Notify the user or account holder who submitted the allegedly infringing content that the material has been removed or disabled.
  • Take reasonable steps to inform the affected party of the counter-notification process, where applicable.

Torvela reserves the right to decline to act on incomplete or clearly invalid notices. We may also forward the submitted notice, including any contact information provided, to the user whose content has been removed or disabled.

4. Counter-Notification Procedure

If you believe that material you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must be a written communication that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled, and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of a competent court in the location in which you are based, and that you will accept service of process from the person who provided the original infringement notification or an agent of such person.

Upon receipt of a valid counter-notification, Torvela will forward it to the original complainant and may restore the removed material within ten (10) to fourteen (14) business days unless the copyright owner files an action seeking a court order to prevent the restoration of the material.

5. Repeat Infringer Policy

Torvela maintains a strict policy regarding repeat copyright infringers. In appropriate circumstances, and at our sole discretion, Torvela will terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is any user who has been the subject of more than one valid and properly submitted DMCA takedown notice, or who has otherwise demonstrated a pattern of infringing the intellectual property rights of others.

6. Misrepresentation

Please be aware that knowingly making a materially false statement in a DMCA notice or counter-notification may result in civil liability. Before submitting any notice or counter-notification, we strongly recommend that you consult with a qualified legal professional to assess the merits of your claim. Torvela accepts no responsibility for third-party submissions made in bad faith or in error.

7. Modifications to This Policy

Torvela reserves the right to modify or update this DMCA Policy at any time. Any changes will be posted on this page with a revised effective date. Your continued use of our platform following any such changes constitutes your acceptance of the updated policy. We encourage you to review this page periodically to stay informed of any updates.
